Thank you for considering to spend your vacation in a Top Tier at Reunion property. We want you to have an exceptional time whilst you are with us and so ask that you take the time to read through the following Terms and Conditions as our intention is for you to have transparency and experience no hidden surprises to spoil your stay.
By making a reservation you are entering into a legal rental contract with Top Tier at Reunion and therefore agree to and are bound by Top Tier at Reunion terms and conditions as set forth.
Payment Terms and Conditions
A deposit of 20% of the reservation total is required at the time of booking along with a copy of the front and back of the credit card used together with a copy of a government issued ID showing the same name.
- The balance is due 8 weeks prior to the arrival date
- For reservations made within 2 weeks of the arrival date the lead guest is also required to check in at the front desk prior to entering the home and will be required to produce the credit card used to pay for the reservation, government issued ID and an official document showing their name and address as shown on the ID provided. This document can be but not limited to a utility bill, credit card or bank statement. Access information to the rental property will NOT be provided and no monies paid will be refunded if the guest fails to complete the required process.
- A Damage Deposit is required on all reservations, the amount may vary for certain reservations or periods at the sole discretion of Top Tier at Reunion. The deposit is returned within 14 days of departure less any charges applied to cover damages discovered by the Top Tier team during their departure inspection and inventory. If any excessive cleaning is required or any furniture has been moved within the home or to another property, the labor cost of putting the items back will also be charged against this deposit.
Rental & Occupancy Terms and Conditions
- The lead guest (person signing the reservation agreement) must be 25 years or older or an active member of the Armed Forces. The lead guest is responsible for ensuring all guests abide by the occupancy terms and conditions
- The guest understands and agrees that they have rented the property from the arrival date to the departure date on the Reservation Agreement and in no way have a lease agreement meaning the property must be vacated on the departure date. Guest agrees that all persons on Property have transient status pursuant to § 82.045 Fla. Stat. (2017).
- You should report any damage to the property or its contents discovered on arrival within 12 hours of your arrival to the Top Tier at Reunion office, email [email protected] or call 863-867-8437
- Only those guests listed on the original reservation may occupy the property unless the guest advises Top Tier prior to the check in date and the total party remains under the maximum occupancy.
- Governed under Florida State Law, maximum occupancy must not be exceeded above the number shown in the property description. (Children under 3 years of age on the departure date are excluded from the maximum occupancy)
- Social Functions on the Property. No parties, groups, gatherings, events, or other social functions are allowed unless specifically authorized in writing by Top Tier at Reunion. Upon a violation of this term, the Guest agrees to vacate the Property, or be subject to removal by police. An exception exists for pre-approved parties which are subject to approval in writing and additional fees.
- During the occupancy period of the property if any unlawful activity or local ordinance is not abided by the guests it will result in the entire guest being removed from the property with no refund. Guest agrees Top Tier at Reunion has the right to remove any persons in violation of § 509.141 Fla. Stat. (2017). And, Guest agrees to vacate, agrees Top Tier at Reunion has the right to remove Guest & Guest’s party for breach of this agreement, and Guest waives any statutory right to a refund.
- The guests agree to abide by all HOA rules within the Reunion Resort & Golf Club to include but not limited to parking, noise, trash and golf course rules.
- Under Florida State law every property is fitted with a hardwire pool safety alarm and/or a pool safety fence, in most cases both. This is to protect the safety of all guests but especially children. Anyone tampering with or disconnecting pool alarms are committing a misdemeanor of the second degree, punishable by a $5000.00 fine or one year in jail.
- Check -in is from 4:00pm on your arrival day. If you wish to secure a guaranteed earlier check in you will need to arrange that subject to availability through the Top Tier office at least 96 hours prior to your arrival date and pay the applicable fee. Within that time frame and your arrival date you may request a complimentary early check in which may be given at the sole discretion of Top Tier. Early check ins will not be granted in a property where a guest has checked out the same day.
- Check out is at 10:00am on your departure day. If you wish to secure a guaranteed late check out you will need to arrange that subject to availability through the Top Tier office at least 48 hours prior to your departure date and pay the applicable fee. You may request a complimentary late check out 24 hours before your departure which may be given at the sole discretion of Top Tier. Late check outs will not be granted in a property where another guest is due to arrive on the same day. Any guest who does not vacate the property at their agreed time will be charged an additional rate equal to one day, (variable on property) against their Damage Deposit.
- Supplied in each property in addition to a fully equipped kitchen including a refrigerator, freezer, oven, range, microwave, dishwasher, small appliances, cookware, dishes, glasses, utensils, linens, and towels. Each property also includes a full-size washer and dryer, iron, ironing board and hairdryers. Bath, hand, face, make up and pool towels are provided, the quantity will require the guest to launder them unless one of the housekeeping services is requested. Vacation homes are self-catering accommodations and whilst Top Tier at Reunion provides complimentary starter supplies of toiletries, toilet paper, kitchen roll, dish and laundry cleaning items, a coffee/tea tray and trash bags. Once these items are used, it is the Guest’s responsibility to replenish them or for your convenience pre order one of our welcome packs.
- For safety, Guests shall comply with all laws and rules affecting it. Fireworks, open flames, intoxication by occupants, and inherently dangerous activities are prohibited. Fire extinguishers must be used appropriately. Report chirping alarms, as they indicate low batteries in safety devices. Furniture cannot be taken outside or moved without the express written approval of the Mgmt. Co. Alarms and smoke detectors cannot be tampered with. Use the overhead stove fan when cooking to avoid accidental activation of the smoke detector. The quiet enjoyment of neighbors must not be disturbed.
General Terms and Conditions
- All properties are individually owned, and every effort will be made by Top Tier to ensure everything in the property is in good working order, however appliances and amenities do break down. If the guest makes any report to Top Tier regarding something not working, Top Tier will make every effort to resolve the issue within 24 hours and keep the guest updated.
- All property descriptions on the web site are made in good faith, Top Tier and the Owner accept no liability for any errors or omissions.
- Whilst Top Tier make every effort to update the web site, décor, furnishing and amenities within the property can change at any time and does not constitute reason for cancellation, refund or compensation.
- Pets are not allowed in any property unless a certified service animal which must be advised at the time of reservations. Top Tier on behalf of the owner have a right to protect the health of any incoming owner and or guests who may have allergic reactions. “Service Animals, “as defined by §413.08, Fla. Stat. (2017) and including animals in training, are exempt from this section, provided a written request for reasonable accommodations is made at the time of reservation. A person who knowingly and willfully misrepresents herself or himself as using a service animal or being qualified to use a service animal commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083. Any unauthorized pet found to be in the property will incur a deep cleaning fee from the guest Damage Deposit.
- Smoking/Vaping is strictly prohibited inside or on the balconies of any property. Guests may smoke/vape on the exterior pool deck but are reminded not to discard any smoking/vape product on the patio or landscaping areas.
- The guest agrees to abide by all rules of the HOA and Kingwood within the Reunion Resort to include but not limited to, parking, nuisance behavior, no RV’s, trailers, refrigeration trucks or commercial vehicles.
- Many of the properties have amenities including but not limited to theme rooms, slides, climbing frames, rope bridges which the guest agrees they are using at their own risk.
- Pool & Spa heat must be requested by the guest and is offered at an additional cost unless otherwise stipulated in the property description. The daily cost varies per property. It must be taken for the duration of your stay, will be turned on 24 hours prior to your arrival and runs for 10-12 hours per day which will maintain pool temperature and also allow the spa heat to be activated at any time.
- Pool Safety, running & diving are prohibited. Children, of any age, are not allowed in the pool area without supervision. When available, safety fencing & pool alarms must be used at all times and doors must be kept closed & locked. Any safety concerns, including if any equipment, pool alarms, safety netting, or locks, are not working properly must be reported immediately to the Management Company. Disabling Pool Alarms is strictly prohibited.
- Wildlife & Insects. Florida wildlife may pose a danger so approach all wildlife & outdoor areas with caution. With our tropical climate bugs are a common occurrence.
- Bed Bugs. The Property has been inspected to ensure no bed bugs are present, so the presence of any bed bugs is presumed to have been caused by the Guest unless the Guest provides clear and convincing proof otherwise. Guests must vacate the property immediately without refund and pay for treatment to remove the bed bugs.
- Lost or Stolen Property. Top Tier at Reunion is not responsible for lost or stolen property. Top Tier will attempt to contact the guest if any personal items are left behind on departure and return them at the guest’s expense. Guest agrees that personal property left on Property at the end of the Rental Period shall be deemed abandoned if good faith attempts to return it fail.
- Adverse Weather Top Tier does not offer refunds or reschedule bookings due to tropical storms or hurricane activity. If you are concerned about the possible interruption, cancellation or delayed travel due to tropical occurrences, you are strongly encouraged to purchase travel insurance at the time of booking.
- Access by Top Tier at Reunion and its agents may enter the Property as necessary to protect or inspect The Property; for repairs or services; or for emergencies. The notice must be provided to the extent reasonable under the circumstances.
- For all Top Tier Properties the following terms apply
- 61 days or more prior to arrival date will receive a full refund including the deposit.
- 31 – 60 days prior to arrival date will receive a 50% refund.
- 30 days or less before arrival date, zero refund will be available to the guest.
Reservations will be canceled with no refund if the guest provides false information during the reservation process or plans to advertise or host a Party/Event that was not disclosed in writing to Top Tier by the guest. There are no refunds for unmet expectations resulting from weather, natural disasters, personal, or any other reason unless contained herein. Top Tier at Reunion reserves the right to cancel reservations and refuse service to anyone, to the extent permitted by law. Travel insurance is highly recommended. The damage deposit varies by home and we also reserve the right to charge a higher damage deposit at our sole discretion.
- Cancellation by Top Tier at Reunion. In the event of the rental property being no longer available through unforeseen damage or circumstances beyond the company’s control, we will seek to offer alternative accommodation of same or higher standard. Failing that a full refund of all monies paid to the company will be made but that will constitute the limit of the company’s liability.
- ELECTRONIC SIGNATURES By signing your name electronically you are agreeing that your electronic signature is the legal equivalent of your manual signature on this form or any other documents to be delivered in connection herewith, and do so for the purposes of validity, enforceability, and admissibility. When signing electronically you consent to be legally bound by this Agreement's terms and conditions.
Limitation of Liability
- Top Tier at reunion and/or the Owner do not accept liability for equipment failure and/or services in the Property. In the event of failure of equipment, the Guest must notify Top Tier at Reunion as soon as possible, so that they may have an opportunity to address and rectify the issue within 24 hours of being notified
- Top Tier at Reunion and/or the Owner do not accept liability for lost or stolen personal property of the Guest within the Property during the rental period. In the event that property of the Guest is lost or stolen, the Guest should advise the appropriate authority first, and then contact Top Tier at Reunion to report the lost or stolen items.
- It is solely the responsibility of the guest to ensure that children are supervised at all times. It is the policy of Top Tier at Reunion that all children under the age of 16 years are not left in the property un-supervised by a responsible adult at any time during the rental period.
- All amenities supplied with the property including but not limited to baby equipment, gaming, toys, swimming pool with no life guard are all used by the Guest at their own risk.
- BBQ’s and outdoor appliances are used by the guests at their own risk but caution should be used at all times around BBQ’s, fire pits and any other flamed device. Children should never be left unattended near an open flame.
- Signage is posted for the information and safety of the guest and should be adhered to at all times.
Chargebacks. Guest waives any right to dispute a credit or debit charge, request or demand a chargeback, or dispute that a detailed item description was provided, the contact information was clearly and prominently displayed, and grievance policy instructions were provided.
Attorney’s Fees. Top Tier at Reunion shall be entitled to reasonable attorneys’ fees and costs from the Guest for defending chargeback demands, negative publicity, social media, BBB claims, administrative, or other complaints and arbitration, litigation arising out of this agreement, or otherwise. No party has third-party beneficiary rights under this agreement as to any benefits received are merely incidental.
Data Usage. Guest consents to the use by Top Tier at Reunion of its data, subject to governing law.
